Use of any information you provide to us or which is collected by us on or through the Site is governed by this Privacy Policy.  By using the Site, you consent to this Privacy Policy, whether you have read it or not.  If you do not agree with this Privacy Policy, please do not use the Site.

(“Confidential Information”).  Additionally, you may provide comments, photos, or other submissions (“Other Information”) when visiting or interacting with the Site.

On occasion, we may ask for demographic information such as age or gender.  You may choose not to provide such information and may still use the Site, but may not be able to use any services where such information is required.

By using the Site, you agree to enter true and accurate information on the Site. If you enter a bogus email address we have the right to immediately inactivate your account.

When you browse the Site, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system so we can better improve the experience for all our users.

WHAT WE DO WITH YOUR INFORMATION

Email marketing: With your permission, we may send you emails about new products/offerings, free and premium content (i.e. blog posts, YouTube videos, reports/whitepapers, etc.), and special events.

CONSENT

When you provide us with Confidential Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason (i.e. newsletters, tips, and marketing messages), we will ask you directly for your expressed consent and provide you with an opportunity to withdraw your consent.

You may withdraw your consent at any time by clicking on an “unsubscribe” link which is offered at the bottom of every email we send.  We manage email lists through a list management system and it is possible you may be on more than one list.  Unsubscribing from one of our lists will not necessarily remove you from all lists.

We do not knowingly collect or solicit any information from anyone under the age of 13 and the Site is not directed at children under the age of 13.

IMPORTANT: We do not sell, rent or otherwise disclose your Confidential Information or Other Information to any third parties, including but not limited to advertisers, strategic partners or vendors.  Again, we take your privacy very seriously.

ASSIGNMENT OF RIGHTS

If the Site is merged with another company, or the assets of Terri Ward, LLC are assigned, sold, or transferred, you agree we can transfer your information to the new owners so that they may continue to sell and support our products and services.  Please note that any purchasing party may not use your information in a manner that is materially inconsistent with this Privacy Policy without your prior consent.

DATA RETENTION

If you have an online account with us, you may close your account at any time by visiting the ‘Account Settings’ page for your account.  After you close your account, you will not be able to sign in to the Site or access any of your personal information.  However, you can open a new, separate account at any time or re-active your previous account by following instructions we will give you at the time you close your account.  If you violate our Terms and Conditions, we have the right to deny access by deleting or suspending your account.

If you close your account, we may still retain certain information associated with your account for analytical purposes and recordkeeping integrity, as well as to prevent fraud, collect any fees owed, enforce our Terms and Conditions, take actions we deem necessary to protect the integrity of our Site or our users, or take other actions otherwise permitted by law.  In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

SECURITY AND DATA STORAGE

TerriWard.com uses Hyper Text Transfer Protocol Secure (HTTPS) with Secure Sockets Layer (SSL) encryption – currently SHA-2 and 2048-bit, the strongest on the market.

The Site and shopping cart are hosted at Godaddy.com where your data is stored on a secure server behind a firewall.

Payments for purchases made in our Store are processed via PayPal or Square, allowing you to use your PayPal account, Visa, MasterCard, American Express, or Discover.  These payment gateways encrypt data through the Payment Card Industry Data Security Standard (PCI-DSS) established by the PCI Security Standards Council. THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

Once you leave our store the Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or Terms of Service of TerriWard.com.

COOKIES

TerriWard.com utilizes cookies to create a more customized experience for our users and customers. For example, we use a login cookie so members do not have to re-enter their username and password each time they return to the Site. DISPUTE RESOLUTION

You also agree that, in the event any dispute or claim arising out of or relating to your use of the Site or this Privacy Policy, you and Terri Ward, LLC will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Washington County, Oregon with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that to the maximum extent permitted by applicable law, you will not be entitled to recover attorneys’ fees, even if you would otherwise be entitled to them.
